Terms of Use  & Service

Effective Date: October 11, 2026

Welcome to The Ink Conservatory. These Terms of Use and Terms of Service (“Terms”) govern your access to and use of our website, online shop, and related services.

The Ink Conservatory (“we,” “us,” or “our”) is an independent bookstore and online retailer offering books, literary gifts, and bookish merchandise.

By accessing our website or placing an order, you agree to these Terms. If you do not agree, please discontinue use of our website.

1. Use of Our Website

You may use our website for lawful, personal, and informational purposes, including browsing products, learning about our business, and making purchases.

You agree not to:

  • Use our website for any unlawful, fraudulent, or misleading purpose.

  • Attempt to gain unauthorized access to our website, systems, or other users' information.

  • Interfere with the website's operation, security, or availability.

  • Introduce malicious code or engage in activities that could harm our website or its users.

  • Copy, reproduce, distribute, or commercially exploit our website content without authorization, except as permitted by law.

  • Use automated systems to access or collect information from our website in a manner that violates applicable law or interferes with our operations.

We reserve the right to restrict or terminate access to our website when reasonably necessary to protect our business, customers, website, or legal rights.

2. Products and Product Descriptions

We make reasonable efforts to present our products accurately, including their descriptions, photographs, prices, and availability.

However, colors and visual details may appear differently depending on your screen or device. Product images may also be illustrative where expressly indicated.

Books and merchandise may vary in condition, edition, format, packaging, or other characteristics. Where relevant, we will describe the product's condition and notable features in the product listing.

For used books, minor signs of previous ownership or normal wear may be present. Any significant condition details known to us will be disclosed in the product description.

We reserve the right to correct errors in product descriptions, pricing, availability, or other listing information, subject to applicable law and any rights arising from a completed order.

3. Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable sales taxes and shipping charges may be added at checkout.

Payments are processed through Square using the payment options made available at checkout. By submitting an order, you authorize the applicable payment transaction for the amount presented during checkout.

We reserve the right to correct pricing errors and cancel or decline orders where permitted by law. If we cancel an order after payment has been collected, we will arrange an appropriate refund.

Your payment information is also subject to the applicable terms and privacy practices of Square and any other payment service involved in your transaction.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products under these Terms.

Order confirmation does not necessarily mean that an order has been finally accepted or shipped. We reserve the right to decline or cancel an order when reasonably necessary, including when a product is unavailable, a pricing or listing error has occurred, payment cannot be authorized, or fraud is suspected.

If we cancel an order for which payment has been collected, we will provide an appropriate refund.

We may contact you using the information provided with your order if we need to clarify order details, resolve a payment issue, or communicate a fulfillment problem.

5. Shipping and Delivery

We prepare and pack orders ourselves and use Square and the United States Postal Service (USPS) as part of our shipping workflow.

Shipping charges, estimated processing times, and delivery estimates will be provided where applicable during checkout or in the relevant product or shipping information.

Delivery estimates are not guarantees unless expressly stated. Once a package is transferred to USPS or another carrier, transit times and delivery events may be outside our direct control. We will make reasonable efforts to assist with shipping issues and communicate material delays of which we become aware.

You are responsible for providing a complete and accurate shipping address. Additional charges, delays, or delivery problems arising from incorrect or incomplete address information may affect fulfillment.

If we cannot ship an order within the promised timeframe, we will provide any notice, cancellation option, or refund required by applicable law.

Please consult our Shipping and Returns Policy for additional information about processing times, shipping, returns, and refunds.

6. Returns, Refunds, and Cancellations

Our return and refund rules are described in our Shipping and Returns Policy, which forms part of these Terms.

Please review that policy before placing an order. It explains applicable return conditions, time limits, refund procedures, and any product-specific restrictions.

Nothing in these Terms is intended to waive or limit consumer rights that cannot legally be waived or limited.

7. Intellectual Property

Unless otherwise indicated, the content on our website—including our original written descriptions, branding, logos, graphics, photographs, and website design—is owned by or used with permission by The Ink Conservatory or the relevant rights holder.

You may browse and share links to our website for personal, noncommercial purposes. You may not reproduce, modify, distribute, publish, or commercially exploit our original content without prior permission, except as permitted by law.

Book titles, book covers, character names, author names, publisher marks, and other third-party materials may be protected by copyright, trademark, or other intellectual property rights belonging to their respective owners. Their appearance on our website does not imply that we own or control those rights.

If you believe content on our website infringes your intellectual property rights, please contact us with sufficient information for us to review your concern.

8. Artificial Intelligence (AI) Transparency

The Ink Conservatory may use artificial intelligence tools to assist with internal research, brainstorming, planning, administrative tasks, business operations, and other productivity activities.

Our use of AI as an internal tool does not mean that we endorse AI-generated creative work or that our products are AI-created.

We do not sell products represented as AI-created products, and we do not endorse AI-created art or images as a creative category. We value human creativity, authorship, craftsmanship, and the work of artists, writers, and makers.

We aim to offer books and merchandise selected or presented in keeping with our values and to describe products honestly. We do not knowingly misrepresent an item's creator, origin, or production method.

AI tools may assist with certain internal processes or website and business materials. Their use does not, by itself, establish the origin, authorship, or production method of every item, image, or piece of content associated with our business. Where the origin of a particular product or creative work is material to a purchase, customers should rely on the relevant product description or contact us for clarification.

We reserve the right to update our internal AI practices as technology, applicable law, and our business standards evolve.

9. Third-Party Services and Links

Our website may include links to or integrations with third-party services, including Wix, Square, USPS, and social media platforms.

These services operate under their own terms, policies, and practices. We do not control all aspects of third-party services and are not responsible for their independent content, availability, or policies.

Your use of a third-party service may be subject to additional terms imposed by that provider.

10. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using our website, you acknowledge that you have had the opportunity to review that policy. Where applicable law requires consent or another legal basis for particular processing, this acknowledgment does not replace that requirement.

Our Privacy Policy explains the types of information we collect, how we use and share it, and the choices available to you.

11. Disclaimers

Our website and its content are provided on an “as available” basis, subject to applicable law.

We make reasonable efforts to maintain accurate listings and reliable website functionality, but we do not guarantee that the website will always be available, uninterrupted, error-free, or free of harmful components.

To the extent permitted by applicable law, we disclaim warranties that are not expressly provided in these Terms. Nothing in this section excludes warranties or protections that cannot legally be excluded.

12. Limitation of Liability

To the extent permitted by applicable law, The Ink Conservatory will not be liable for indirect, incidental, special, or consequential damages arising from your use of our website or inability to use it.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable consumer protections.

These Terms do not affect any rights or remedies you may have under applicable law.

13. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful use of our website, your violation of these Terms, or your infringement of another person's rights.

This provision does not require you to indemnify us for our own unlawful conduct or for matters where such an obligation would be prohibited by law.

14. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in a court with appropriate jurisdiction, subject to applicable consumer-protection laws and rules governing venue.

15. Changes to These Terms

We may update these Terms to reflect changes in our business, website, products, services, or legal obligations.

When we make changes, we will update the Effective Date at the top of this page. Changes will apply prospectively to the extent required by law. Where necessary, we will provide additional notice or obtain consent.

We encourage you to review these Terms periodically.
